Terms of Service

These Terms of Service ("Terms") govern your use of the website at oscohouse.com and any booking made for an OSCO House residence. Please read them carefully before reserving a stay. By making a booking or using this website you accept these Terms.

1. Acceptance of terms
By accessing this website, creating a booking, paying a reservation deposit, or staying in an OSCO House property, you confirm that you have read, understood and agree to be bound by these Terms, by our Privacy Policy, and — once signed — by the property-specific seasonal lease agreement ("Contrato de arrendamiento de temporada") executed at check-in under the Spanish Urban Leases Act (Ley 29/1994 de Arrendamientos Urbanos, "LAU"), Art. 3.
If you book on behalf of another person or a group, you represent that you have authority to bind every member of the group to these Terms and to the lease, and you remain jointly responsible for compliance and for any sums due.
We may update these Terms from time to time. The version in force on the date of your booking governs that booking. Material changes will be highlighted on the website and, where appropriate, communicated by email.
2. Eligibility
To make a booking you must be at least eighteen (18) years old and legally capable of entering into a binding contract under the law of your country of residence. You must provide a valid government-issued identity document (passport or, for EU/EEA residents, national identity card) for every adult guest who will occupy the property.
OSCO reserves the right to refuse or cancel a booking if the guest cannot provide acceptable identification, if information provided is inaccurate or fraudulent, or if there is reasonable suspicion of misuse of the property (for example, use as a film set, a commercial event venue, or for any unlawful purpose).
3. Booking, payment, and cancellation
3.1 Booking confirmation
A booking is only confirmed once (i) OSCO has issued a written confirmation by email, (ii) the reservation deposit has cleared, and (iii) the identity verification of all named adult guests has been completed. Until all three conditions are met, dates are held provisionally only.
3.2 Payment
Payments are processed through Stripe Payments Europe, Ltd. OSCO does not store full card data. Pricing is shown in EUR (or, for some markets, in JPY/USD); the EUR price is binding. Stripe may apply currency-conversion fees that are outside OSCO's control. A reservation deposit equal to one month's rent (or, for stays shorter than one month, fifty per cent of the total) is due at booking. The balance, together with any refundable security deposit, is due no later than seven (7) days before check-in.
3.3 Cancellation by the guest
Cancellation terms mirror the property-specific lease and are applied as follows:
- 30 or more days before check-in — full refund of all sums paid, less any non-refundable third-party fees (e.g. Stripe processing).
- Between 7 and 30 days before check-in — fifty per cent (50%) of the total booking value is retained; the balance is refunded.
- Less than 7 days before check-in, or no-show — one hundred per cent (100%) of the total booking value is retained.
If you must cancel because of a documented serious medical event or a government travel ban affecting your country of departure or Spain, contact us — we will review on a good-faith case-by-case basis, but no automatic refund is guaranteed beyond the schedule above.
3.4 Cancellation by OSCO
If OSCO must cancel a confirmed booking for reasons attributable to OSCO (for example, an unforeseen issue with the property), we will offer either a full refund or, where possible, a comparable alternative property at the same or lower price for the same dates.
3.5 Modifications
Date changes are subject to availability and to the rate applicable to the new dates. Requests must be sent in writing to ops@oscohouse.com at least fourteen (14) days before the original check-in.
4. Use of the property
OSCO homes are residences first. You agree to use the property exclusively as your private temporary residence, and to respect the building, the neighbours, and the city. Specifically:
- No subletting or assignment. You may not sublet, license, or assign use of the property, in whole or in part, on Airbnb, Booking.com, or any other platform.
- No parties or events. Gatherings exceeding the registered guest count, ticketed events, photo/video shoots, and any commercial activity are prohibited without prior written consent.
- Smoking. Smoking, vaping and any open flame are prohibited indoors. Outdoor terraces are permitted only where designated, and you remain responsible for fire safety.
- Quiet hours. Quiet hours are observed daily from 22:00 to 09:00 local time, in line with the building's community rules and Spanish municipal noise ordinances.
- Maximum occupancy. Each property has a maximum guest count stated in the booking confirmation. Exceeding it is grounds for immediate termination of the lease without refund.
- Pets. Pets are not allowed unless expressly approved in writing in advance.
- Compliance. You will comply with all applicable Spanish laws, building rules ("normas de comunidad"), and local ordinances, including waste-separation and short-stay-registration requirements.
5. Damages and liability
An inventory and condition report ("inventario") is completed at check-in and again at check-out. You are responsible for any damage to the property, its furnishings, fixtures or contents caused by your negligent or wilful conduct, or by the conduct of any person you allow into the property. Ordinary wear and tear is not chargeable.
The refundable security deposit may be applied, in whole or in part, against the cost of repair, replacement, deep-cleaning, or against unpaid charges. Where damage exceeds the deposit, the balance is invoiced separately and is payable within fourteen (14) days. OSCO will provide photographic and written evidence on request.
To the maximum extent permitted by Spanish law, OSCO's aggregate liability to the guest arising out of or in connection with these Terms or the stay is limited to the total amount paid by the guest for the booking, except in cases of death, personal injury caused by negligence, fraud, or any liability that cannot be excluded under mandatory consumer-protection law.
6. Identification and legal registration (Real Decreto 933/2021)
Spanish law requires lodging operators to collect and transmit traveller identification data to the Ministry of the Interior. This obligation is set out in Real Decreto 933/2021, of 26 October, regulating the registration and information duties of accommodation activities.
Before or upon check-in, every adult guest must submit a clear copy of their passport (or, for EU/EEA residents, of their national identity card) through our secure check-in flow. We will transmit the prescribed fields to the relevant police authority (SES.Hospedajes) within the legal deadline. Failure or refusal to provide the documentation will prevent check-in, and the cancellation schedule in Section 3.3 will apply. Passport images are retained only as long as needed to comply with the law and are then deleted — see our Privacy Policy.
7. Force majeure
Neither party is liable for failure or delay in performing its obligations under these Terms where the failure or delay is caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disaster, fire, flood, severe weather, war, terrorism, civil unrest, epidemic or pandemic, government order, border closure, strike, or failure of public utilities. The affected party will notify the other promptly and the parties will discuss a fair adjustment, which may include rescheduling or a partial refund.
8. Intellectual property
The OSCO and OSCO House names, logos, the visual identity, the photography, the floor plans, the copywriting, the source code of this website, and all related materials are owned by OSCO HOUSE S.L. or its licensors, and are protected by Spanish and EU intellectual-property law and by international treaties. No right or licence is granted by these Terms other than the limited right to view the website for personal, non-commercial purposes.
You may not reproduce, distribute, modify, publicly communicate or create derivative works of any of the foregoing without OSCO's prior written consent.
9. Governing law and jurisdiction
These Terms, the booking, and the seasonal lease agreement are governed by the laws of Spain. The parties submit to the exclusive jurisdiction of the Courts of Barcelona, Spain.
Nothing in this Section deprives a guest who qualifies as a consumer under Spanish or EU law of the protection of the mandatory provisions of the law of the country in which they have their habitual residence, including the right to bring proceedings in the courts of that country. EU consumers may also use the European Commission's online dispute-resolution platform at ec.europa.eu/consumers/odr.
10. Property-specific lease
A property-specific seasonal lease agreement ("Contrato de arrendamiento de temporada", LAU Art. 3) is signed at check-in for every stay. That lease takes precedence over these general Terms where the two conflict, except on matters that mandatory consumer-protection law reserves to these Terms or that the lease cannot lawfully modify.
